2. Scope of Services

Embyn offers a range of creative services, including:

• Brand Strategy & Identity Design

• Web Design & Development

• UI/UX Design

• Creative Consultation

• Content & Visual Design Support

The scope of work, deliverables, and timelines for any project will be defined in a written agreement or proposal approved by both parties before the start of the project.

3. Client Responsibilities

To ensure smooth collaboration, clients are expected to:

• Provide accurate and complete information relevant to the project

• Respond to feedback or deliverable reviews in a timely manner

• Supply any required assets (content, images, credentials)

• Meet agreed payment schedules outlined in their project agreement

Delays in communication or asset delivery may impact project timelines and scope.

4. Payments & Fees

All payments are due as outlined in the approved proposal or contract.

• A deposit may be required to begin a project

• Remaining balances are due according to the milestone or final delivery schedule

• Embyn uses secure, third-party payment platforms

• Late payments may result in paused work or project termination

All fees quoted are exclusive of applicable taxes unless otherwise stated.

5. Ownership & Intellectual Property

• Embyn retains ownership of all original design work until full payment is received

• Upon full payment, project-specific rights are transferred to the client as defined in the contract

• Embyn may showcase completed work for portfolio, promotional, or case study use unless agreed otherwise in writing

6. Confidentiality

We respect your privacy and confidentiality. Any sensitive or proprietary information shared with Embyn will remain confidential and will not be disclosed to third parties without written consent.

7. Limitation of Liability

While we strive to deliver exceptional results, Embyn is not liable for:

• Indirect, incidental, or consequential damages

• Service interruptions from third-party platforms (hosting, CMS, integrations)

• Delays caused by client-side inaction or external factors

Total liability is limited to the amount paid for services.

8. Termination

Either party may terminate the engagement with written notice. In the event of termination:

• Work completed up to that point will be billed accordingly

• Any unused deposit or prepayment may be refunded at Embyn’s discretion

• Deliverables may be withheld until outstanding payments are resolved

9. Revisions & Scope Changes

Each service package or proposal includes a specified number of revision rounds. Any work beyond the agreed scope or revision limit will be considered additional and may be billed separately.

10. Updates to Terms

Embyn reserves the right to update these Terms of Services at any time. Updates will be posted on this page, and your continued use of our services implies acceptance of those changes.
